Matters to be neglected in determining compensation

  • The degree of urgency of the acquisition
  • Any disinclination of the person to part with the land
  • Any damage sustained by the person interested which, if caused by private person, would not be good cause of action.
  • Any depreciation in the value of the land acquired likely to result from the use which it will be put when acquired
  • Any increase in the value of the land acquired likely to result from the use which it will be put when acquired
  • Any improvement to land acquired after the date of publication of declaration under Sec 8, unless for normal maintenances.

The degree of urgency of the acquisition: How badly or quickly the government needs the land doesn’t lower the price. Just because it’s an emergency project doesn’t mean they can pay you less.

Any disinclination of the person to part with the land: The fact that you don’t want to sell or leave your land is not considered. You don’t get extra money for being unwilling or emotionally attached.

Any damage sustained by the person interested which, if caused by private person, would not be good cause of action: You can’t get money for losses that wouldn’t normally be considered a legal injury. For example, you can’t claim compensation for a temporary inconvenience that isn’t a real legal damage.

Any depreciation in the value of the land acquired likely to result from the use which it will be put when acquired: You can’t ask for a reduced price because of what the government plans to do with the land. For example, if they’re building a garbage dump next to your other property, that future drop in value isn’t subtracted from your compensation for the land being taken.

Any increase in the value of the land acquired likely to result from the use which it will be put when acquired: You don’t get a higher price because of what the government plans to do with the land. For example, if they’re building a new metro station that will make the area more valuable, that future increase isn’t added to your compensation.

Any improvement to land acquired after the date of publication of declaration under Sec 8, unless for normal maintenance: Once the official notice to acquire the land is published, any new buildings or improvements you add (like a new shed or extra floor) cannot be included in the price, unless it’s just normal repairs or upkeep to keep the property in its current condition.
